Complaint What Happened It is my understanding that per 15 USC 1681 ( a ) ( 2 ) ( A ) ( i ), my consumer report should not contain information solely as to transactions or experiences between the consumer ( me ) and the person ( you ) making the report. Payment history and the late payments associated with payment history negatively impacts my consumer report and are considered as part of my transactions and experiences between your company and me. Furthermore, I am requesting that you provide me with, in writing, the reasonable procedures ( according to 15 USC 1666 ( b ) ) that you have adopted to ensure that each periodic statement is mailed to me ( the consumer ) not later than 21 days before the payment due date. Complaint What Happened To whom it may concern, Ive noticed several deviations from mandatory reporting standards therefore the data in my report can not be accurate and complete! With that said, I deny your allegations and I challenge you to provide proof that you have the right to report this incomplete negative information on my credit report. Per 15 U.S.C 1681e Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 12 CFR Part 1022 ( Regulation V ) requires furnishers to : Furnish information concerning accounts or other relationships with a consumer that has integrity. Furnish information about accounts or other relationships with an accurate consumer. C - Conduct reasonable investigations of consumer disputes According to CRRG, to make a lawful report, you must follow the XXXX XXXX compliance standards. Also as stated in the CRRG Any Deviation From These Standards Jeopardizes The Integrity of The Data. This means that any mistakes in reporting claims can make the information less accurate and it affects the accuracy of any federally regulated reports. Therefore, I am invoking my rights to challenge these inaccurate and non-compliant items. Neglecting my demand will only prove that you DO NOT care about my rights as a consumer. Its NOT FAIR for you to report information that isnt confirmed to be ethical and meets the standards of certified reporting. Complaint What Happened To whom it may concern, Ive noticed several deviations from mandatory reporting standards therefore the data in my report can not be accurate and complete! With that said, I deny your allegations and I challenge you to provide proof that you have the right to report this incomplete negative information on my credit report. Complaint What Happened You Violated the United States Code Law ( TILA 15 U.S. Code 1666 ( b ) billing error ) Recently I checked my credit report and noticed multiple billing errors under 15 U.S. Code 1666 ( b ) billing error - ( 4 ) The creditor 's failure to reflect properly on a statement a payment made by the obligor, or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. As I know the creditor didnt notify me 21 days before with a statement so there should be no late payments on these accounts. I demand to see hard solid proof from the creditor bank account that I didnt pay and was marked late because this clearly a billing error. Complaint What Happened " The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of TILA US Code 1666B since I was never late. I recently reviewed my consumer report and noticed an incorrect late payment record on my XXXX XXXX account [ XXXX ]. I have always maintained timely payments on this account. Under the Fair Credit Billing Act ( FCBA ) and the Truth in Lending Act ( TILA ), creditors are required to accurately report consumer transactions and provide a mechanism for correcting errors in a timely manner.
