29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. On or about February 23, 2021, the employer failed to certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards of 14 feet, 3 inches while performing construction activities on a residential structure without using fall protection. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d). |

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On 03 October 2019, at a worksite located at 176 E. Butterfield Rd, Elmhurst IL. 60126, an employee of Home Build Corp was in the process of installing the siding on a commercial structure. The employee was working from a boom style aerial lift and was wearing a fall arrest harness with a lanyard that was not attached properly to the boom. This exposed the employee to a fall hazard. Abatement documentation is not required. |
