For example, if employees working immediately adjacent to a Class I asbestos job are exposed to asbestos due to the inadequate containment of such job, their employer shall either remove the employees from the area until the enclosure breach is repaired; or perform an initial exposure assessment pursuant to (f) of this section. a. On or about March 25, 2014, at the above addressed jobsite, employees were exposed to thermal system insulation containing 10-70% chrysotile asbestos and/or PACM during construction activities. The employer failed to protect employees from exposure including, but not limited to when regulated areas were not established, exposure assessments had not been completed, access was not limited and ACM and/or PACM waste was not contained in sealed, labeled bags and disposed of properly.

Citation text line 29 CFR 1926.1101(d)(5): All general contractors on a construction project which includes work covered by this standard shall be deemed to exercise general supervisory authority over the work covered by this standard, even though the general contractor is not qualified to serve as the asbestos "competent person" as defined by paragraph (b) of this section. As supervisor of the entire project, the general contractor shall ascertain whether the asbestos contractor is in compliance with this standard, and shall require such contractor to come into compliance with this standard when necessary. a. On or about March 25, 2014, at the above addressed jobsite, employees and subcontractor employees were exposed to thermal system insulation containing 10-70% chrysotile asbestos and/or PACM during construction activities. The employer as general contractor did not ascertain whether the asbestos work conducted was in compliance with the standard and make changes to ensure employees were adequately protected from asbestos exposure.

Conductors shall be run as multiconductor cord or cable assemblies or open conductors, or shall be run in raceways. All conductors shall be protected by overcurrent devices at their ampacity. Runs of open conductors shall be located where the conductors will not be subject to physical damage, and the conductors shall be fastened at intervals not exceeding 10 feet (3.05 m). No branch-circuit conductors shall be laid on the floor. Each branch circuit that supplies receptacles or fixed equipment shall contain a separate equipment grounding conductor if the branch circuit is run as open conductors. a. On or about March 25, 2014 - at the above addressed jobsite, employees conducting demolition and cleanup operations on the 1st floor were exposed to conductors that were not protected from physical damage, thereby exposing the employees to electrical hazards.

Panelboards shall be mounted in cabinets, cutout boxes, or enclosures designed for the purpose and shall be dead front. However, panelboards other than the dead front externally-operable type are permitted where accessible only to qualified persons. Exposed blades of knife switches shall be dead when open. a. On or about March 25, 2014 - at the above addressed jobsite, two (2) electrical panels were not protected with covers, thereby exposing the employees who were conducting demolition and cleanup operations around the panels to arc flash/blast hazards. b. On or about March 25, 2014 - at the above addressed jobsite, unused openings in the live electrical panel box were not guarded to prevent employee contact, thereby exposing the employees to electric shocks.
