Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible agricultural ingredient dust explosion, and deflagration hazards while working near or upstream of an unprotected outdoor dust collector: a) On or about August 12, 2022, the United Air Specialists, Inc. model FJHI6-8-H filter media dust collector servicing the Silo Building collected combustible agricultural ingredient dusts from upstream bagging operations. The outdoor dust collector lacked means of (1) explosion protection and (2) deflagration propagation protection (isolation) for the upstream processed via the dirty air inlet ducting, the area beneath the dust collector via the material hopper discharge, and the area to the side of the dust collector via the clean air exhaust duct. |

On or about August 12, 2022, in the silo building packaging area, employees were exposed to hazards of burns and impact from pressure wave (shock) and/or projectile fragmentation when the electrical wiring utilized in the bagging station(s) were not rated for use in a Class II location. Ordinary wiring such as, but not limited to, ordinary extension cords were in use during bagging operations and were not rated for use in a Class II area. |
